Terms of Service

1. Acceptance of these terms

By downloading, installing, or using Portside (the "app") or visiting portside.work (the "site"), you agree to these Terms of Service. If you don't agree, please don't use the app or the site.

2. About Portside

Portside is a personal nautical logbook for mariners. It is developed and maintained by Mark Bureros ("we", "us", "the developer"). It is not a company, partnership, or registered business — it is an independent product.

Portside is designed to be offline-first. You can use it entirely on your device without an account. Cloud Sync is optional.

3. Your account (Cloud Sync)

You may create an account to enable Cloud Sync. If you do:

You are responsible for keeping your password secure.
You must provide a valid email address you control.
You are responsible for all activity under your account.
You can delete your account and all synced data at any time from within the app: Settings → Account → Delete Account.

We may suspend or terminate accounts that abuse the sync service (e.g. automated scraping, excessive requests, attempts to access other users' data).

4. Your content

Everything you enter into Portside — vessel names, port calls, dates, ranks, coordinates, notes — belongs to you. We claim no ownership over your logbook.

If you enable Cloud Sync, you grant us a limited license to store and transmit your records on your behalf (via Supabase). That license ends the moment you delete your account.

You are responsible for the accuracy of what you enter. Portside is a personal record-keeping tool — it is not a source of truth for official or legal purposes.

5. Acceptable use

You agree not to:

Reverse-engineer, decompile, or attempt to extract source code, except where permitted by law.
Use the app or site to break any law or regulation.
Attempt to interfere with the Cloud Sync service or access another user's data.
Redistribute, resell, or rebrand Portside without permission.

6. Cloud Sync and future pricing

Cloud Sync is currently free for all signed-in users. We intend to introduce a paid tier in the future (via Google Play Billing). If that happens:

Existing free features will remain free — including local logging, which will always be free with no account required.
You will be notified in-app before any change that affects your account.
You will never be charged without your explicit consent.

Bottom line: local logging is free forever. Cloud Sync is free today and may become a paid add-on later — but you'll always be told before anything changes.

7. Intellectual property

Portside, the app, the website, its design, and its code are owned by Mark Bureros. Map data, seamarks, and third-party assets are owned by their respective providers (see the in-app Legal & Licenses sheet for full attribution).

The name "Portside" and the ship logo are not to be reused without permission.

8. Navigational disclaimer

Portside is not a navigational system. It does not replace official charts, ECDIS, or any required maritime equipment. It must never be used as the sole means of navigation.

All seamarks, buoys, lights, and port information shown in the app are rendered from third-party open data and may be incomplete or outdated. Always consult the relevant national hydrographic office before and during any voyage.

9. Disclaimer of warranties

Portside is provided "as is" and "as available", without warranty of any kind, express or implied. We do not warrant that:

The app will be uninterrupted, error-free, or free of harmful components.
Any data shown in the app is accurate, complete, or current.
Cloud Sync will always be available or will never lose data.

You use Portside at your own risk. Always keep independent backups of anything important — the app provides JSON and CSV export for exactly this reason.

10. Limitation of liability

To the maximum extent permitted by law, Mark Bureros shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Portside — including but not limited to loss of data, loss of profits, navigational errors, or business interruption.

Because Portside is provided free of charge, our total aggregate liability to you for any claim arising out of or relating to these terms or the app shall not exceed zero US dollars (US$0.00).

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and, where reasonable, notify users in-app.

Continued use of Portside after a change means you accept the updated terms.

12. Termination

You may stop using Portside at any time. You can delete your account and synced data from within the app, and uninstall the app from your device to remove local data.

We may suspend or terminate access to Cloud Sync if you violate these terms. Local logging on your device is unaffected by any such termination.

13. Governing law

These terms are governed by the laws of the Republic of the Philippines, where the developer is based. Any dispute will be resolved in the courts of Davao City, Philippines.

If you are accessing Portside from outside the Philippines, you are responsible for complying with your local laws.
